Mad’s Magical Moments (Mad’s Balloon Co.) – Terms & Conditions

Payment

Payments must be made through Squarespace. You are required to provide an active email address to complete your invoice. Major credit/debit cards are accepted.

  • A 50% non-refundable, non-transferable retainer fee is required within 48 hours of receiving your invoice to secure services.

  • The remaining balance is due 14 days before the event date.

  • Failure to pay the balance in full will result in cancellation and forfeiture of payments.

Refunds

Mad’s Magical Moments (Mad’s Balloon Co.)specializes in balloon décor installations and Bounce House Rentals. A 50% non-refundable deposit is required for all services.

  • No refunds are given for any portion of the deposit.

  • Once the order is accepted, work begins immediately (designing, planning, and material sourcing).

  • Written notice is required for cancellations or rescheduling.

  • Failure to notify within required timeframes may result in:

    • Forfeiture of payments

    • Release of event date/time

    • Termination of contract

    • Cancellation fees

Rescheduling

Clients may reschedule with 14 days written notice.

  • New date must be within 365 days, subject to availability.

  • Client should include a first and second choice of reschedule dates.

  • If no availability exists, standard cancellation policies apply.

Cancellations

  • Cancellations with 14+ days written notice: No cancellation fee. (Payments already made remain non-refundable.)

  • Cancellations with less than 7 days notice: $100 cancellation fee.

  • Within 48 hours of event: All payments are forfeited.

  • More than 48 hours before event: Refund amount is at the discretion of Mad’s Magical Moments (Mad’s Balloon Co.)based on industry standards.

All cancellation requests must be in writing.

Design Adjustments

If Client is unsatisfied with final product, Mad’s Magical Moments (Mad’s Balloon Co.)may agree or decline to make adjustments at their discretion.

Acceptance of Proposal

By booking, the Client accepts the prices, specifications, and conditions and authorizes Mad’s Magical Moments (Mad’s Balloon Co.) proceed.

Independent Contractor

Mad’s Magical Moments (Mad’s Balloon Co.)and all affiliated team members operate solely as independent contractors, not employees.

Venue Requirements

Client must verify all venue rules regarding:

  • Helium tanks/balloons

  • Tall structures

  • Ladders

  • Wall hanging permissions

  • Electrical needs

Failure to verify venue rules results in forfeiture of payments.

Setup Time

Please allow at least 3 hours for setup unless otherwise agreed.

Venue Access

All passes, permits, and access information must be provided 24 hours before installation.
Mad’s Magical Moments (Mad’s Balloon Co.)is not liable for incomplete installs due to lack of access.

Client Installations

If Client elects to transport/install décor themselves:

  • Must be communicated in writing beforehand.

  • Delivery & installation fees are waived.

  • Client assumes full responsibility for outcome and materials after pickup.

Mad’s Magical Moments Installations

  • Delivery & installation fees are included in event pricing.

  • Any remaining balance must be paid before installation begins.

  • Extra time left after installation is not subject to refunds.

  • All equipment remains the property of Mad’s Magical Moments (Mad’s Balloon Co.)unless otherwise stated.

Striking & Disassembling

Clients are responsible for removing balloons after event.

If equipment is rented, a team member will retrieve it.
Failure to remove balloons from rental equipment may result in additional fees.

Striking services by Mad’s Magical Moments (Mad’s Balloon Co.)may be added during booking; fees are non-refundable.

Ordering Clause

Materials are ordered 24–48 hours after deposit.

  • Contact the Creative Director immediately for any changes.

  • Clients cannot supply their own balloons.

Reductions, Additions & Changes

Once Terms & Conditions are signed:

  • No color changes, décor removals, or additions are permitted.

  • A separate order may be placed for additions but acceptance is at the Creative Director’s discretion.

Material Guarantee

All materials are guaranteed per the manufacturer. Mad’s Magical Moments (Mad’s Balloon Co.)may substitute items of equal or greater quality if needed.

Any damage to company-owned equipment while in Client’s possession will be charged to the Client.

Ownership of Equipment

All equipment is rental-only and remains the property of Mad’s Magical Moments (Mad’s Balloon Co.)

Client agrees to return all items as instructed.
Lost or damaged items will be billed to the Client.

Helium Balloon Float Time

Approximate float times:

  • Latex: 12 hours

  • Mylar/Foil: 1 week

Weather conditions may impact longevity. Outdoor décor carries additional risk.

Display & Promotion

By booking, Client grants Mad’s Magical Moments (Mad’s Balloon Co.) permission to use photographs and videos of décor for marketing, including:

  • Website

  • Social media

  • Flyers

  • Commercials

  • Promotional materials

Mad’s Magical Moments (Mad’s Balloon Co.)reserves full design and photo rights.

Accident Clause

Client agrees to hold Mad’s Magical Moments harmless from any injuries or damages related to balloons, equipment, or helium misuse, including but not limited to:

  • Choking

  • Latex allergies

  • Popping-related injuries

  • Property damage (including pool filters)

Supervision of children and guests around balloons is the Client’s responsibility.

Outdoor Decor Clause

Outdoor balloon décor is not guaranteed.
No refunds for weather-related popping, movement, or deterioration.

Inclement Weather Clause

Mad’s Magical Moments (Mad’s Balloon Co.) not responsible for postponed or canceled events due to weather.
We will try to accommodate date changes when possible.

Vendors & Event Coordinators

Mad’s Magical Moments: (Mad’s Balloon Co.)Is responsible only for balloon décor and its workspace.

  • Does not assist other vendors.

  • Is not liable for delays caused by other vendors.

  • Must be kept informed by Client if an event coordinator is involved.

Assignment Clause

This agreement cannot be transferred without written approval from both parties.
No modifications are valid unless in writing and signed by both parties.

Exclusivity Clause

Mad’s Magical Moments (Mad’s Balloon Co.)will not perform décor if another balloon company or unapproved volunteers are decorating at the same event.
Violation allows Mad’s Magical Moments (Mad’s Balloon Co.)to leave the venue without refund.

Travel Policy (Out-of-Town Services)

  • Out-of-town = 50+ miles from Lexington, KY

  • Additional travel fees apply and are based on distance, time, and accommodations.

  • Travel fees will be communicated prior to booking and itemized in the invoice.

  • Client must acknowledge and agree to travel fees before scheduling.
